Terms of Use

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to purchase from the Site.

• We sell live plants and related goods. Because plants are natural, living products, size, shape, color, and form will vary, and photographs are representative rather than exact.
• We strive for accuracy, but product descriptions, pricing, and availability may contain errors and are subject to change without notice. We reserve the right to correct errors and to cancel or limit orders, including after an order has been submitted.
• All prices are in U.S. dollars and exclude applicable taxes and shipping unless stated otherwise.

Your order is an offer to purchase. We may accept or decline it. Charges are processed through our third-party payment providers; by submitting an order you represent that you are authorized to use the payment method provided. A confirmation email does not guarantee acceptance or product availability.

• Shipping costs, timing, and methods are described at checkout and on our Shipping & Returns page. Delivery windows are estimates, and we may time shipments seasonally to protect plant health.
• Certain plants cannot be shipped to certain states due to agricultural regulations; any such restrictions are noted on the product page, and we may cancel items that cannot be lawfully shipped to your address.
• Our zone finder provides USDA hardiness zone information for general guidance only. You are responsible for choosing plants suitable for your location and conditions.

Eligible plants are covered by our 1-Year Alive & Thrive Guarantee as described on our Guarantee page, subject to the conditions stated there. Except as provided by that guarantee or required by law, sales of live plants are final. Please review the Guarantee and Shipping & Returns pages for full details.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Interfere with or disrupt the Site, its security, or its underlying systems;
• Scrape, harvest, or collect data from the Site without our written permission; or
• Resell products purchased from the Site without authorization.

The Site and its content - including text, graphics, logos, images, and software - are owned by or licensed to Arbor Buddy and are protected by intellectual-property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written consent.

The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. Growing results depend on factors outside our control, such as climate, soil, watering, and care.

To the maximum extent permitted by law, Arbor Buddy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order.

You agree to indemnify and hold harmless Arbor Buddy and its officers, employees, and partners from claims arising out of your misuse of the Site or violation of these Terms.

These Terms are governed by the laws of the United States and the state in which Arbor Buddy is organized, without regard to conflict-of-law rules. We may update these Terms from time to time by posting a revised version here with a new “Last updated” date; continued use of the Site constitutes acceptance of the changes.
